How to Fight a Driver’s License Suspension After a DWI Arrest in Texas
One of the most immediate consequences of a Texas DWI arrest is the possibility of losing your driver’s license. For people who depend on driving to reach work, transport children, or attend medical appointments, a suspension can cause serious disruptions. Many drivers do not realize that the administrative license proceeding is separate from the criminal prosecution. At The Law Office of Alex Tyra, P.C., we help clients throughout Longview and East Texas understand the steps available to contest a proposed suspension.
The Administrative License Revocation Process
Texas Transportation Code Chapters 524 and 724 govern many administrative suspensions arising from DWI arrests.
A suspension may be initiated when a driver refuses qualifying breath or blood testing or when testing establishes an alcohol concentration at or above the applicable threshold.
The Texas Department of Public Safety administers the process, while contested hearings are conducted through the State Office of Administrative Hearings.
The 15-Day Hearing Deadline
Under Texas Transportation Code §§ 524.031 and 724.041, a driver generally must request an ALR hearing within 15 days after receiving the applicable suspension notice.
If the driver does not timely request a hearing, the suspension ordinarily takes effect on the 40th day after the notice was served. If a timely hearing is requested, the suspension is stayed pending the administrative law judge’s final decision.
Issues That May Be Contested
Depending on the type of proceeding, the hearing may address reasonable suspicion, probable cause, alcohol concentration, or the circumstances surrounding a testing refusal.
We examine the arrest records and available evidence to identify the issues that can be challenged.
Even when a suspension cannot be prevented, some drivers may qualify for an occupational driver’s license under applicable Texas law.
